These Terms of Service (“Terms”) govern your use of the Gorgeous You Beauty Mart online store and your purchase of products from us. This store is operated by Gorgeous You Beauty Mart in Malaysia. By visiting the store or placing an order, you agree to these Terms. If you do not agree, please do not use the store.

1. Online store terms

You must use this store only for lawful purposes. You must not misuse the store, interfere with its operation, attempt unauthorised access, transmit malicious code, or use the store in a way that infringes another person’s rights.

You are responsible for ensuring that information supplied when placing an order, including your name, contact details and delivery address, is accurate and complete.

2. Products and product information

We take reasonable care to describe and present our products accurately. Product colours and appearance may vary slightly because of screen settings, lighting, photography, packaging updates and individual display devices. Product descriptions, shade guidance and images are provided to assist your selection and do not replace your own assessment of suitability.

Cosmetic results and experiences may vary between individuals. Unless expressly stated and supported, information on this store is not intended as medical advice or as a promise of therapeutic results.

We may update product information, packaging, availability or presentation where reasonably necessary, provided that this does not affect any rights you have under applicable Malaysian consumer law.

3. Pricing and currency

Prices displayed on the store are in Malaysian Ringgit (MYR) unless stated otherwise. The price charged is the price shown at checkout when your order is submitted, subject to correction of an obvious error before we accept the order.

Any discounts or promotional offers are subject to their stated conditions and availability. We may change prices or promotions prospectively without notice.

4. Orders and order acceptance

Submitting an order is an offer to purchase. Receipt of an order confirmation does not necessarily mean that we have accepted the order. We may decline or cancel an order before fulfilment where reasonably necessary, including because a product is unavailable, payment cannot be confirmed, order information appears incorrect, fraud is suspected, or an obvious pricing or listing error has occurred.

If we cancel an order after payment has been received, we will arrange an appropriate refund. We may limit or refuse orders that reasonably appear to be placed for unauthorised resale or other improper purposes.

5. Payment

You agree to provide current and accurate payment information. Payments are processed through the payment methods shown at checkout and may be subject to the payment provider’s terms and security checks. An order will not be prepared for dispatch until payment is successfully confirmed.

We do not guarantee that every payment method will always be available. We are not responsible for delays caused solely by a bank or payment provider outside our reasonable control, but we will provide reasonable assistance where appropriate.

6. Product availability

All products are subject to availability. Stock information may occasionally change before an order is processed. If an ordered product is unavailable, we will contact you and arrange an appropriate resolution, which may include cancellation and refund of the unavailable item.

7. Shipping

We currently ship within Malaysia. Shipping, order-processing and delivery information is governed by our Shipping Policy, which forms part of these Terms. Please review it before ordering.

Delivery estimates are not guarantees. Courier disruptions and other circumstances outside our reasonable control may affect delivery.

8. Returns and refunds

Returns, incorrect orders, damaged or faulty products and refunds are governed by our Refund & Returns Policy, which forms part of these Terms.

We do not offer returns or refunds solely for change of mind, choosing the wrong shade, no longer wanting the product, or personal preference regarding colour, finish, texture or appearance. This does not exclude any rights or remedies available under applicable Malaysian consumer law.

9. Product authenticity

Gorgeous You Beauty Mart supplies authentic products. Customers may use the relevant manufacturer authentication system where available. Instructions for LipAddict verification are provided on our Authenticity page.

Authentication services operated by manufacturers or third parties may be subject to their own systems and terms. We do not control those independent systems, but customers may contact us for assistance relating to products purchased from our store.

10. Accuracy and availability of the store

We endeavour to keep store information accurate and current, but occasional typographical errors, interruptions or omissions may occur. We may correct errors and update information where reasonably necessary, including after an order is submitted, subject to applicable law and any order already accepted.

We do not guarantee uninterrupted or error-free access to the store. Maintenance, technical problems or third-party services may temporarily affect availability.

11. Prohibited use

You must not use the store or its content:

for unlawful, fraudulent or misleading activity;
to infringe intellectual property, privacy or other legal rights;
to transmit malware or harmful code;
to scrape, copy or exploit store content without permission;
to interfere with store security or operation; or
to place fraudulent, abusive or unauthorised orders.

We may restrict access or cancel affected orders where we reasonably believe these Terms have been breached.

12. Intellectual property

The store design, text, graphics, photographs, logos and other content are owned by or licensed to Gorgeous You Beauty Mart or their respective rights holders. They may not be copied, reproduced, distributed or commercially exploited without prior permission, except as permitted by law.

Product names, logos and trademarks remain the property of their respective owners. Their appearance on this store does not transfer any ownership rights.

13. Third-party services and links

The store may use or link to third-party services, including Shopify, payment providers, couriers, product-authentication services and app stores. Those services may have their own terms and privacy practices. We are not responsible for third-party websites or services outside our reasonable control, although this does not affect obligations we owe you under applicable law.

14. Limitation of liability

To the fullest extent permitted by law, Gorgeous You Beauty Mart will not be liable for indirect, incidental or consequential loss arising solely from use of the store or circumstances outside our reasonable control.

Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded or limited under applicable Malaysian consumer law. Where liability can lawfully be limited, it will be limited only to the extent permitted by law.

15. Indemnification

To the extent permitted by law, you agree to be responsible for reasonable losses, liabilities or costs arising directly from your unlawful use of the store, your material breach of these Terms, or your infringement of another person’s rights. This section does not apply to the extent that a loss was caused by Gorgeous You Beauty Mart or where such responsibility cannot lawfully be imposed.

16. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be applied to the greatest extent permitted by law or severed where necessary. The remaining provisions will continue in effect.

17. Changes to these Terms

We may update these Terms prospectively to reflect changes to our store, services or legal obligations. The latest version will appear on this page with its updated date. Changes do not retrospectively remove rights relating to orders already accepted.

18. Governing law

These Terms are governed by the laws of Malaysia. Any dispute will be subject to the jurisdiction of the Malaysian courts, without limiting any right a consumer may have to pursue another remedy available under applicable Malaysian law.
